The association
in fact, or not declared
It acts people who gather in an abstract way around a common idea. No formality is necessary and it are not obliged to have statutes but are not adapted at all to a commercial activity.
A not declared association does not enjoy the legal capacity of a legal entity: she cannot thus receive subsidies or gifts, to open of bank account, to sign contract, of lease nor to engage of the personnel.
________________________________________________________________________________ ______In fact declared associations obtained the approval of a Ministry. Sometimes this approval makes it possible to obtain tax exemptions and can be necessary to make a request for subsidy.
To know if you can profit from an approval or if you are obliged to have one of them, contact your Prefecture, your Ministry of supervision or your federation for the sporting clubs.
________________________________________________________________________________ ______This recognition relates to associations from which the mission of general interest or public utility extends to the fields philanthropic, social, medical, educational, scientific, cultural or relates to the quality of the life, the environment, the defense of the sites and the monuments, international solidarity.
The recognition of public utility is granted by decree as a Council of State. The conditions of obtaining are very strict:
They were created in 1987. Their statutory object is to place people deprived of employment (in particular RMIstes, long-term unemployeds and unemployed old of more than 50 years) at the disposal of physical people and morals for uninsured specific activities under the local economic conditions. There exists 1 100 intermediate associations in France (figure established at August 31, 1998).
They are declared and require an approval. They are given exemptions on part of the employer's shares and wage and an exemption of the corporation tax.
